Sounds awfully fishy to be a mistake. I'd report the nurse for malpractice and get her nursing license in jeopardy. Messing around with patients like that is unethical. If you're in the US, check out Filing a Complaint with the Nursing Board.

I'd also talk with the doctor's office and let them know that the offending nurse should never be involved with you or your LO going further.

The audacity of that nurse to go ahead and give the shot after numerous protests...

Um I would be in prison for attacking the nurse. That woman injected your infant with a dead virus that you adamantly told them not to. WTF.

I would be livid! That's not okay in the slightest, and the way she acted afterwards.. disgusting. I would be contacting a lawyer immediately.

She did it on purpose. But you can't prove it. What you can prove is negligence. This nurse is a bully and she needs to be taught a lesson.

I agree 100%. I seriously doubt it was an accident as you'd repeatedly told the doc & nurse & it was written down.
Please report her at the very least but I'd seek legal action against the nurse if I were you.

As someone stated before, you won't be able to seek action against the nurse. It will be against the practice and the practice will then have to deal with the nurse.

We went through something similar when my oldest was being discharged from the Neonatal Intensive Care Unit.

We previously spoke to the Doctor about vaccines (3 days before he received his vaccinations), because we didn't want him receiving all of them. She kept trying to push us into getting all of the vaccines, and simply dismissed us when we tried to push the subject further.

In the end, we decided against the Hep B vaccine. We spoke to the Nurse who was going to give him the injections, and we asked her if we could opt out of the Hep B vaccine. She said yes! She said she did it with her son too. I SIGNED a paper, that specifically stated I did NOT want my son to receive the Hep B vaccine. It was as clear as day! I had to sign an agreement for him to receive his other vaccines too. She took note of this, she even told me what to write on the paper, and she told us she would have to re-order the vaccines he was to receive, since the ones they already ordered had the Hep B included.

My husband and I spoke to the Nurse, and I signed the paper, but what did she do? SHE GAVE IT TO HIM ANYWAY. She KNEW we did not want it, and so did the Doctor. And I didn't even find out through word of mouth, I found out when I read through his 10-15 page discharge papers (which I assume they didn't expect, since they decided to just SNEAK it in there!)

We complained immediately, and all they did was apologize and say they were going to speak to the Nurse and the Doctor and go from there, blah, blah, blah.

Unfortunately, we didn't have a penny to stand on to find a lawyer. It irks me what medical staff can get away with these days. You can't trust majority of them.
