Help with maternity leave and redundancy


I'm so mad I could scream, my maternity leave is due to end 29th November. I'm pretty sure I don't want to return to work. As a single mum with my job being a low income even with tax credit childcare help I don't think it will be financially viable for me to return.

However where I work they are making changes which equate to my normal hours. There is one other member of staff who works the same hours as I do and one of us has to go.

If they wish to make me redundant would I be entitled to any redundancy pay? I've been employed with them since Jan 09 so not quite 2 years. I have contacted CAB who can't really help much until I know more details. Where do I stand with being made redundant while on maternity leave?

you have to be working for more than 2 years to get any redundancy pay

if they made you redundant whilst on mat leave, they would have to give very strong reasons why they chose you and not your colleague.

the only positive thing if you really don't want to go back is, if they make you redundant, you would not have to pay any enhanced mat pay back and you would get any holidays owed paid in full.
