Colleague denied leave of absence till 39 wks

I work for a large company. About 2 years ago my manager went to apply for her maternity leave of absence here in California. My company denied her loa until 39 weeks saying she didn't qualify for disability. She was over 40 years o ldwith her first child and being monitored closely. I wanted to leave at 37.5 wks but I think I'll be denied as well. I do have gestational diabetes but not sure if that would qualify me extra time. Anyone have experience with this?
 
In CA any physician will sign you off 4 weeks before EDD if that's what you want. Your company can't go against this. It'll kick start your state disability payments.
