Paying Out Holidays Earned During Mat Leave

Hi Ladies,

I'm hoping some of you may have experience in this and can point me in the correct direction.

I'm currently on maternity leave (32 weeks pregnant), and do not anticipate on returning to work with my current employer. The company I work for is very "sneeky" when it comes to paying out what is due to their employees, and I've already had issues with my own wages while on leave. Due to this, I do not anticipate on giving my formal notice until my SMP is completed.

During the weeks I have off, I'm accruing holidays. Do I have the option to request that these holidays be paid to me before I hand in my notice? I'm worried that there will be a fight with the company to get them paid after I hand in my notice.

If not, what other options do I have? Contractually, I need to give 1 month notice before leaving work. I will have around 15 days due to me by the time my 52 weeks of maternity leave is up.

The naughty side of me says to take the 15 days at the end of my mat leave, working the week until I get paid, then just leaving, but I want to avoid that!
 
Everyone that I know that has had annual leave outstanding when they hand in their notice has had to take it and my employer will not pay out for it. I think because annual leave is considered a perk of the job!! Personally I would do what you said you don't want to do! Give in your notice with a leaving date that takes into account your annual leave days. Also remember that whilst you are being paid SMP you also accrue bank holiday leave entitlement so you may have more annual leave than you realise!!
 
I did the same as you hun, my work were also like that but after I handed my notice in they gave me a pay slip covering all my holidays at the end of mat leave, which was greater than i expect - woo hoo!
 
I to intend to hand in my notice 1 month before the end of my unpaid mat leave by which point I will have acrude just over 3 weeks holiday pay, this should be paid to me at the end of my notice period. I know that a friend at work did this without any problems. Good luck

That's what I hope I would be able to do, but knowing my employer, they will fight me on paying those days out.
