Really need advice please

I don't really understand how everything works but want to let you know my situation you hopefully someone can help

I'm on maternity leave right now and the part of the company I work in has just been sold.

My SMP started this month so will it just continue at the new company?

Also, if i decided I don't want to go back to work which I actually don't know as the new location will be too far for me to commute - will I have to pay back my maternity?

I told my employer before we were sold that I was returning in April 2011 but now we are sold I don't know where I stand

Help!
 
If you are only on SMP you won't have to pay anything back if you decide not to return.

You shouldn't notice any changes in your pay as I assume that your contract will just be ongoing with the new company rather than starting from scratch as a new employee. Just watch out for this though as some employers like to try and employ you as a new starter. ie. this means you will not have been employed long enough for SMP but they won't have a leg to start on with this usually.

I started my maternity in March and my company payed me full maternity until now its finished so i just get SMP until the end of 2010

Do i still not owe anything back as like you said, im just on SMP now?

smp is 90% of your wages for the first 6 weeks then £124.88 for 33 weeks (total 39)
anything over this is classed as enhanced mat pay and the difference has to be paid back.

some people call the £124.88 SMP but it's actually the whole 39 week plan that's SMP.
