annual leave???

Hi girls!

Help! DH has put in his request for Annual leave for next year. in it contract it states, he has 26 days, has to leave time off for Christmas as where he works shuts down between Christmas and new year (So we have left 5 days-looks like it would be 4 but would rather leave more!) that is all it says.

There is a un-tten rule in his department that no more than 1 person can be off in his department at any time-there is only 4 of them. so understand this. the annual leave board is up for next year in his department it is blank, so as far as we know no one else has asked for time off.

Our baby is due in Feb, he should get the 2 weeks paternity leave :)

We asked if have nearly 1 day off every 3 weeks roughly, from end of march time, and a week off in June, when we hope to go away. between the 1st may-30th sep this works out to 13 days, so within the rules. however they have said he can just have 1 day off at a time. Even though he must have had about 10 off them this year!!!

Can they do that, where do we stand? xxxxxx
 
Employers can stipulate when you take time off and can refuse time off if it is not in the business interests. Saying that they have to allow you to be able to take your entitlement each year. Having the odd day off could be refused though and they are not in the wrong.
Does your DH work full-time? As the statutory minimum holiday is actually 5.6 weeks for full-time workers which usually equates to 28 days per year and yet you state he only gets 26 days.
 
Here it is against the law for the business to not allow time off if it is applied for in the right way.
 
Thanks embob-Yep he works full time 40 hrs a week. Sorry, he get 26 days annual leave he can choose, plus all bank hols. Looks like there is not a lot we can do then. Thanks just wanted to check.
