My hubby as a note off doc stating light duties only ....work have said either your fit for work or not ...basically refusing to give him lighter work ...he asked to speak with human resources they refused to let him....if he goes off sick we are screwed as i dont start work till september
 
depends what kind of work your husband is in i suppose. However, I dont think his work can send him home unfit for work if he has asked to work, even if it is only light duties!!
 
He works in a tesco warehouse ...on goods out which is heavy work but if they put him on battery, goods in , pe-ing (sp) they are all lighter work ...tbh more light work then heavy work & he is trained for all ...he is staying his shift but its killing him :(
 
my works policy is if your not fit for the role in your job description then they can contact doctor to see if the problem is going to be long term if they say yes they can sack you!!! think the only time they do do light duties is if your pregnant!

Thats basically how they have been with him ...4th time sick in 2 yrs over same problem he as had the op on both hands and is on countless painkillers but can barely cut his own dinner some days ...hes depressed feels like a failiure :( ....I start back 7th sept cant go any earlier cos thats when term starts ...really not sure how we will get thru till them but damn work grr
 
That doesnt seem right. I work for tesco and have found that they are usually pretty flexible. There not allowed to refuse that he speaks to HR there job is to look after the staff. Is he part of the union?
 
They shouldn't be able to do that and they can't refuse him to speak to HR!

I thought that you werent allowed to be sacked because of an illness or disability? Thats why so many folk take the piss etc
 
From what I know, if your doctor has written to advise your Husband is able to fulfil light duties whilst sick, then I believe they do have to accommodate this. Should your Husband be on long term sick and after health checks with the doctor arranged by the employer it is seen that the situation isn't likely to improve, then the employer can reserve the right to end his employment. In this day and age though, they do have to tread very carefully as not to fall into the hands of discrimination.

What you could do is either pop into your local Waterstones or Borders shop and have a look at the Employment Law section which should provide you with lots of info on sickness in the workplace etc, or you can have a look at www.i-resign.com where you will more than likely find a nice HR person who can respond to your query in the forum section.
