Child support question

Well, I lied, two questions.
If the father has little to no income and is dependent on his parents, are they required to pay child support?
If they are does that give them a right to fight for visitation?
 
it depends on how old he is?
and a court requires for child cupport to be paid wether its from his parents or him
and visitation is a different story
 
Even if he's unemployed Desi, he'll still have to pay some type of child support. It'll be lower than if he was employed, but you'll still get something.

He'll always be able to fight for visitation rights unless you get some type of restraining order.
 
He's now 18 and from what i've heard and his fb (to those of you who know he blocked me, I have friends that keep tabs) it appears he will be going to college in PA so I doubt he will have any income.

I'm not worried about him fighting for visitation, if he's man enough to ask, I will probably work something out with him...i'm concerned with his parents trying to get visitation if in fact they are held liable to pay the child support. But kind of comically, he literally hid from me when my mom and I showed up at the store. We said nothing to him, just passed him...but he sure bolted like we were the plague.
 
Nope, his parents can't fight for any sort of visitation, unless they had custody of the baby at some point...which they don't!

You can definitely get child support from him. The court won't care where he gets it, they just want to make sure it gets to you.

If you don't mind, do you know what college he's going to in PA?
 
St Joseph's University or something to major in their supermarket program. -rolls eyes-

Well, in Oklahoma it doesn't matter what age the FOB is or if he's unemployed.

Law says that if you want child support, and he is the father that he's obligated to get a job and pay child support.

So no matter what he has to pay it, it's up the judge to decide how much.
 
...as far as visitation, is generally thought that his parents should visit with the child during his parenting time. There's nothing keeping them though from filing for grandparent's visitation and if it's awarded you are to abide by it.

Child support & visitation are 2 different things. Even if someone owes like $50k in back c/s - they are still entitled to their visitation.

I'm going back a long ways here but, it used to be that someone in your bf's position would be ordered to pay a bare minimum of c/s (I think it used to be like $25/mo or so)
Chances are, no matter what the judge orders - it's not going to be much, and probably will order a DNA test
 
Even if he admits the child is his? That would be a bit annoying and a waste of money. =P
In my state, luckily, his parents have no ground what so ever for visitation as they will never have had a relationship with the baby and no case to argue that the child would be emotionally damaged by the loss of their presence. If he is going to be made to pay, even if he has no income and not them, there really will be no place for them to try thankfully. Not that they would want to see the baby out of care or compassion...just to piss us off.
 
In Canada the grandparents can apply for grandparents rights allowing them 2 weeks visitation a calendar year.

The other poster is correct that in Canada child support and visitation ARE treated as two separate issues.
 
I don't know what the law is like there but here in order to get child support there needs to be proof he is the biological father, and if it is proven that he is then he has the right to take you to court for visitation/residence orders. Regardless of the country though if he is unemployed it will not be a lot of money.
 
I can't speak personally about Canada & c/s and visitation, even though I am here now
I can speak about how it used to be in the US because that's where I used to live

You may think of this child as 'yours' - but the child does have another bio parent
c/s & visitation - nothing will be decided until...
1 - the child is born and...
2 - you make an application to the court

eta - and yes, it is totally possible that even if he admits he's the father that a judge can order a DNA test to be sure
Lots of men have admitted to being fathers in the past only to have to turn out that they were not
It's very difficult to dispute factual evidence like DNA
 
^ Yeah, I forgot to add that. I'm pretty sure once you take him to court for child support they do a paternity test to make sure he is the father.
 
Here it doesnt matter employed are not the FATHER has to pay, parents of the FOB cannot pay (unless they give him the money) Here they will take their licence, repo their vehicle, garnish wages (if they are working) ect.

And as for visitation, the father, unless the courts find other whise has visitation rights period.
 
Again as I think this was missed by a few.

I do not mind working something out, chances are supervised visitation unless he turns around, but I was concerned about the father of the baby's parents. They are under no circumstance being involved with my child, and as far as I am aware, in the state of Connecticut, they have no rights. The only reason I was worried was because I was not sure if they would have to pay child support because he was dependent on them, which would be a separate issue than the laws I have looked up.

Hmm I don't think they would have to if he is over the age of 18 even if he is dependent on them , I could be wrong tho
