Anybody know if there is any chance of me being able to terminate parental rights?

He would voluntarily sign them over. I could cite alcohol abuse, PTSD, failure to pay child support, and no contact with the kids as reasons.

If he is voluntarily signing over his rights.. i do not see why not.

i don't think you need justifications, i may be wrong though, if he is voluntarily signing them over.

I've gotten a little bit more information. Even with him voluntarily terminating his rights it is very hard to do and courts don't like to approve a termination of parental rights without a step-parent adoption in process.

That makes sense...

Best of luck to you mama! :hugs:

Problem is that I want to make out a will and include guardianship provisions. If I don't get parental rights terminated the court can set aside those provisions in favor of the father - even though he has abandoned the boys, never paid child support, and he is a complete stranger.:nope:

thats just not fair. i was wondering how this was going for you ... i would really like it to where my mom gets my LO if something were to happen to me. well maybe with the information you have against him it can help win a case. just plain sad... these men take no responsibility yet they still have "rights"... ha what a joke. is he on BC?

Yes, he's on the BC and even if he wasn't we were married so it's automatically assumed he's the father. And I agree - it is totally not fair.

o wow :( ... im sorry to hear this. there has to be a way tho to terminate his rights...

exspecially if he is willing to sign over rights.. i do not think courts should step in the way of this!

If he has no contact for over 2 years, it is considered abandonment. I would state that in your will. Go ahead and do it, but put all the reasons why he should not get the kids in there. Make sure you file it in your state, and consult a lawyer if you can. HTH.
