Setting up a limited company whilst still being employed!

Hi all,

My ex has set up a limited company doing what he does in his full time job. He claims he wants to use it to do freelance work! He's been working there for over 10 years and hasn't mentioned any of this to his boss! Is this legal? I find it very immoral and unethical!

Most companies will declare this as a conflict of interest, so he may be breaking his employment contract.

Id have a read through his contract, as they can accuse him of poaching customers, using company resources etc etc so he needs to see if he is breaking any rules asap, as if they find out & its in his contract NOT to do this, he can lose his job.

At work we have a complete honesty policy in our contracts, which includes conflicts of interest.
