SMP vs MA!!!

I am not contracted but classed as self employed in work, although I am not registered self employed and am on the works pay roll (they sort out my nat ins and tax)
This means that wk can't pay me smp but judging by the forms I have to fill in I may not be eligable for MA either!!!! Has anyone been in a similar situation who can help me out? xx
 
im not sure hun.. i was under the impression if work provide you with a smp1 form stating why they cannot pay you smp you can claim MA.. so long as you satisfy MA conditions.. have worked 26 of the 66 weeks prior to due date
 
How are you classed as self employed hun? Can you explain a bit more? Do you pick your own hours? Do you go to work when you want? Do you get holidays?
 
It may depend who pays your National Insurance. If the company do, they will be responsible for your mat pay, If you pay your own NI via HMRC you will get MA frm the government.
 
I just work when they ask me, if i don't work i don't get paid and i'm not entitled to holiday or sick pay etc...... exactly like self employed but not registered with the HMRC
 
Errrrrm I take it from your last post you are not registered as self employed with hrmc ? If thats the case then its down to your employer to pay you maternity pay.

If your employer is paying your NI then your are employed.

Im a bit confused to be honest. I am self employed and am responsible for all my tax, NI, accounts etc. so it sounds to me that you are employed but just on a casual basis
