When does my maternity pay end?

I started my maternity leave on 30th November 2011, the day my baby was born. I get paid SMP, which by my calculation means I should get paid until the end of August as that's 9 months. My boss is only paying me until July though. She says November counts as a full month of maternity pay, even though I worked until 26th November. Is this right? Thanks!

i don't think so... as far as i know smp is paid for 39 weeks and that runs from the Monday of the week you go on leave so that Monday would be week one...?! could always check on direct gov website but pretty sure that's how it works...

Thanks nugget, that's what I thought too, but she is insisting otherwise. I've tried telling her I should be paid until the end of August, but she is 75 years old and not too with it these days and won't listen! I'm not returning to work so really need to get paid as much as I'm entitled to. Don't know what to do about it as she is convinced she is right.

Work out when your first actual smo payment was made, if you're paid monthly then you worked November, so wuld have been paid salary end of December and then smp end of January ? Ndepends on your pay structure though,I am just assuming monthly salary

If you check when you we first paid it you will be able to work out how much you have been paid and how much you should still be due

If there's a discrepancy I would get onto th cab to help you explain to her

39 weeks takes you to 28th August. If you were in work until 29th November and officially started your mat leave on 30th November that is when your SMP started. You said you worked until 26th but your mat leave started 30th - what did you do inbetween? Annual leave?

I calculated wrong - I finished on Friday 25th with the next 2 weeks booked off as annual leave, but Matilda arrived early so my maternity leave had to start on the 30th, the day she was born. So the 28th and 29th were annual leave days. I think she is going to ring someone about it, so hopefully it will be ok.

She just rang and has sorted it out, and I am due payment until the end of August, thank goodness!
