We had to rehome our staff Winston 2days ago, it wasnt an easy decision and i had been thinking bout it for amonth or so. He was 5-6months old, very well behaved but only for my hubby. He had no respect for me at all, even with simple commands such as NO.So for this reason he would try and challenge me and bully me,things like draggin me across the room by my boot, tryin to jump higher then me, barking at me and this started to worryme as we have a 2.5yr old and a 11month old so decided best thing was to rehome him. We decided no dog shelters or kennels, either a friend or a friend of a friend so we can get updates regular on him. I decided best to tell the people we bought him off of as they were our neighbours and really dog crazy lol,and have 5dogs in total 4 of them being staffs and she hit the roof demanding the dog back and saying she would make our life hell if we didnt give him back and i explained we found a loving home up the road and they had even offered us £100 for him to ensure good home and to recover some costs as he cost £300 and that certainlly doesnt come easy now adays.

She said i wasnt a loud to rehome him with anyone else only them and we explained obviously we paid £300 tothemfor him and we were ensuring he was havin a good home and they carried on kicking off,and in the end they offered us the £100 to have him back but i also exopkained he was due to go vets mon/tues for a rash i had been treating athome as advised for vets and they said no we will do that, we will pay for it and we agreed ok then. So the fella come by thurs evening completely fine, polite and said he had his vet appointment booked and we explained that we couldnt manage or i couldnt with 2little ones also wehave a parsons and shes been with us 4-5 yrs now and he was fine about it, he said there and then what he expected the vets to cost and they would do it and we said fine then and left it at that. I think what the couple didnt realise was that they demanded the dog back that day basically givin us no choice and now the bloke come round this morning, handed my hubby a vet bill demanding we pay it shouting and being abusive and said he will report us to RSPCA if we don't and will cause us all manners of hassle! But were so annoyed as the fact is we had sorted a home, was going to take him vets mon/tues once paid but they wouldnt have none of this and new would cause problems in the long run.

The fact is also we paid £300 for this puppy, it was our choice what to do but got put in a position. Where do we stand, does anyone know as they took the puppy back knowing he had a rash and said they would treat it aslong as they could have him back that evening as they so desperately needed and wanted him back, are we eligable then for this as seems very unfair?

These people know have mum staffy, dad staffy, 3pupp staffsand 1 jack terrier cross in a 3bedroom house, there dogs constantly charge at our fence, smash it and break panels, we know they wont fix it now as they are being awkward but one of there staffs are very sharp but we don't have disposable income to pay for things there dogs have done or false promises?

Advice please, experiences andany sites Ican visit to gather more information

UPDATE 16th Oct:

Well basically we got a knock at the door last night and low and behold the RSPCA, I said to him we expected you and he seemes shocked by me saying this. He came through said hello to our dog lola we explained situation with neighbours next door (as told above) and he was here literally 5mins, he could see it was a malicous call, nothing wrong with our dog, talk about waisting there time and he said he said they got a call saying our dog had an eye infection clearly he could see she hadnt, didnt write anything down or ask where food, water, bed was because he said she was a well looked afterdog,a bit spolt after i explainedshe eats a bit like a human lol and went awat.So im happy in the sense that the neighbours will get a letter of fololow up saying no problem at all butannoyed as they think they can just do that :growlmad::nope:
Terrible, im stewing on it but wont do anything as don't wanna start tit for tat and fuel it even more, but just the cheek of it makes me laugh, when they have 6 dogs, all crated out for how many other hours at a time, 1 dog cant be with anyother or anyother dog or around other kids as unsafe and ahhhh makes me sooo angry. But shall let you know what happens next as expecting him to come knocking fri/sat for this money and he will prob do the same be loud, abusive and threatening. Only difference this time hubbies at work this sat and im home alone, but will tell him OH back at such and such time, come back then and if he starts ill call the police om him as wont have that on our doorstep in public with our kids in the next room, thats me vented, opinions please guys, im soooooooo annoyed :growlmad:

Further update 24th Oct:

Well it gets better and better,we had a on the spot check from the Health visitors 2days again which is very rare and random as they don't do that. They phoned and gave me 45min warning to coming round so i dashed about like a blue ass fly remopping, hoovering and they were only ere 10mins and very happy with everything but just a bit random to turn up like that as they have never done b4. But even worse apparantly she has also reported me for fraud to the police, when they took the dog I advised her partner needed collar back for sentimental reason as belonged to a friend that she had for her dog and it died so explained would need it baclk, texted them sat evening askin for it and she sent back sayin vets had removedit and was at the vets and would need to call them, i said id seen him in the garden wearing it as our bathroom window looks right onto there dog run but thought ill go along with what shes saying and pander her drama and stories so messaged back and said id call them monday to get collar back. I phoned and explained I was previous owner and new owners had left collar there and gave my name, hers and dogs name and they didnt have a clue what i was on about funny enough! Yesterday she txt me saying the vets had contacted her to inform her i had phoned up pretended to be her using her name, address to obtain and steal there dogs details! I tell shes a bloody nutter! Surely if i had of pretented to be her the vets wouldnt have known as they don't know every persons voice on the phone! Im getting sooooo annoyed with thisnow really taking the micky. I have messages proving what she said about the collar and to call the vets so shes come unstuck really.

So do you guys think shes a nutter ?

They had no legal right to demand the puppy back. AT the end of the day, the £300 you paid for him means he is now yours legally. (Did you get a receipt?)

As far as the vet bill goes, they handed you £100 for him back which means he is legally theirs now. They chose to take him to an appointment that they had booked, if they took him to the one you had booked they may be able to claim the vets fee from you but not for the one they booked.

I think you're right in thinking they won't fix the vandalism the animals have caused, neighbours like to be awkward if they are pissed.

Sorry you are in this situation. It can't be easy with two little ones.

Unless you signed something to say that the dog was to be returned to them in the event of rehoming, you could have done what you liked with him.

You paid 300quid for him IMO you were being nice by letting them have him back. If the RSPCA come knocking which also IMO is doubtful I would explain what you have told us.
Tell them to whistle for the vets bill.

I think with my cats I had to sign that if I give them up I has to contact the breeder first. I Know she has had cats back, rare, But she has.

Not sure on the legal standpoint though.

Thanks for all your replies, if anyone knows any sites I can visit to get more information that be great, but completely agree with all ppl above. And no they never gave us a receipt or a contract with conditions and never even stated when buying him in the event we decide its not going to work out and want to get rid of him/rehome him they would want him back.

I had to sign a contract to say that if we couldn't keep our puppy, we had to return her to the breeder rather than rehome her ourselves. I think this is something that most kennel club registered breeders do but it isn't compulsory. Most 'good' breeders will take back a puppy they have bred, although they don't sound like they particularly fall into that category.
https://www.doglaw.co.uk/custody.php
This site has lots of info regarding most aspects of law relating to dogs.

If you didn't have to sign a contract then no! I think its funny them threatening you with rspca. With the amount of dogs they have, the fact they have damaged your fence you could so easily report them and do more damage for them of they want to be petty about things! They demanded the dog back there and then so the vet bill should be theres. If they wanna cause you trouble just report them. Xx

Thanks everyone, we shall see what happens when he comes banging on our door saturday. OH has told me not to answer and tell him that hubbies dealing with it and to go away. But i have found we are well within the law. On the doglaw site, Winston the dog would be classed as chattel. You don't buy a car take it for the MOT and askin the seller to pay the bill! Idiots, but everyone I have told totally agrees with us. Thanks again everyone, but any further info or stories of a similar nature would be haelpful

Updated in 1st post of whats happened lastnight, im sooo angry

Good, im glad the RSPCA came and proved what was already true..that your dog is well cared for. They have made themselves look like dicks.

If he knocks, tell him to get off your property or you will call the police and file a complaint of harassment as they have been making malicious andfalse allegations against you.

:hugs: dont worry, you are not in the wrong

Eta I wouldnt even tell him when your OH is home. What did the RSPCA say about the situation

If it were me i would go speak to the police now, say you are feeling unsafe etc so if he does turn up and start giving attitude, there is a note on the property and they can come quicker.

We had one done on our neighbours property as her husband would hit her in the past and i always said if i heard anything i would call straight away (hubby is a police officer and suggested this).

Did you sign a contract when you purchased the dog?

I only have experience with this in the US, so I don't know what the law is there. But, if you signed a contract be sure to read and make sure it doesn't say anything about re-homing or giving back. Most breeders in the US make you sign a contract that says you will give it back to them if you cant care for the animal.

Omg!! The cheeky so and so's! They had no right to demand the puppy back...but seeing as though they paid you £100 for him that now makes the puppy theirs and any bills for vets etc are now theirs! Its like saying "hes hungry, you need to buy him food"...not your responsibility! Rarr I agree with what someone else has said, I would speak to the police and make them aware of the situation and aware of the fact that this man is being threatening and intimidating and explain he has threatened to come round again.

Hope you get it sorted :hugs: xxx

Updated on first post with nutters new antics, god shes annoying me so much

What a drama queen she is. I would honestly laugh in her face and cease all communication with them.

They aren't going to get the money they are after, and I think they are withholding the collar from you to punish you in a childish way.

They really aren't worth the stress. Id write it off as experience now tbh. Bit pathetic and time-wasting of them to involve the police, they are unhinged! X

I really don't understand why you haven't reported them to the police for harassment...?

Because we just wanna ignore it as at the end of the day weplan to live here for some time and im not all for that tit for tat,as much as id like to get my own back im not childish and again for me id personally feel like id be waisting police time over something so petty. So i did call the housing association today to report the fence and they are goin to call me back by friday and atleast that will be sorted but get my own back a little bit aswell! I don't wanna play childish mind games, or shes done this so ill do that, it will soon blow over. They have stopped demanding the money now, haven't even mentioned it so we shall just see what happens over the coming weeks really. Thanks for allyour support and advise, really appreciated
