I'm due to start maternity leave in 3 weeks but I get full pay while on ML (less the social payment). At the moment there is one person on ML in our division and they didn't replace her. And now I'm going on ML and they are not replacing me either. So if they manage without us for our leave I'm thinking they could do without us permanently. I'm just wondering if they can make me redundant while I'm on ML since they are paying me.

Yes I think they can. Sorry if that's not what you wanted to hear.

they can make you redundant. However i think that its a bit more complicated for them. Im not 100% certain on my information but i believe that they can only do it if there getting rid of your job all together. they cant penilise you for being on mat leave. its not straight forward anyway. if it does happen or if you want to be prepared contact acas. they specialise in emplyment law

Hi,

This happened to a lady at my work (I'm in UK BTW) - her whole team became displaced whilst she was off and she was made redundant, however her redundancy notice didn't start until she came back to work, so she had a couple of months back and time to look for another role.

Hope that helps a bit.
