Me and my OH we're talking yesterday about wills. And a questions popped up and just wondered if anyone knew the answer...

If me and OH were to pass away and we hadn't wrote a will... Who would get our children to look after?...
 
The court will appoint a guardian from any friends and family who step forward. It won't necessarily be the closest relative, it will be the based on the best interests of the child (in the court's eyes). In the meantime the children might go into temporary foster care.
 
Thanks. We just wondered cos I wouldn't want my IL's getting custody. I would want my mum x
 
If anything happened to me I wouldn't want my Los dad to have her :haha: I don't think he would care for her properly!

That's good! (Not that me and OH are gonna pass away soon I hope!!!!!) it's just something I panic about. They are the sort of people that wouldn't let me family see my boys if they had them. X
 
From what I was old when making our wills by the legal secretary was that the children would go to the youngest living grandparent! I haven't actually looked it up, but that is what she told us.
 
I didn't want my il's getting my children so i managed to get OH to sort out a will for us. My sister gets my two with money in trust for them, the trust will be run my both sets of grandparents.

Really? That makes me feel a bit sickk. I want to make a will saying that either my Mum or my sister and that my MIL is neer to custody nor contact. She hit my three year old. I hate to think my wishes could be ignored.
 
Its like when people leaves wills and the court allows them to be contested.
It shows zero respect for the wishes of the dead.
