Me n my boyfriend are on the verge of splitting. He has a drink problem and put drink before me and our daughter and dissapears now and again and goes on benders. His mum is also an alcoholic. If we split would he be able to take her over night? as he would have to go back with his mum, id hate for her to go into that enironment with her dad and gran! who also has an abusive and alcholic partner. surely it wouldnt be allowed?

he is on the birth cert.

i would get in touch with a solicitor hun. if he is an alcoholic and you dont want him to have her overnight then certainly you dont have to let him. if he wanted to he could take you to court but i very much doubt he would get granted overnight access to her especially if he i living with his mum and she too is an alcoholic.

if you are not entitled to legal aid then you should get a free advice session from the solicitors.

im assuming you are in scotland so here is the link to the scottish legal aid board website that can give you info on local solicitors and if you are entitled to legal aid.

You could definitely put in place an order through a solicitor to stop him having over night access. Or to stop him having unsupervised access.. He would have to go to a centre or he would have to see your daughter around a family member..
I wouldnt allow my child to go with their dad if he was a drunk!
Its hard hun and you have to do the best you can.. Sounds like he isnt ready for any help.

Social Services should be able to help with this. I am not sure how it will impact you though but I am sure you will be ok. Give them a call anon (if you can) and see what they say. Or call the NSPCC for advice.
