When would I go about applying for it and would I need a lawyer?
 
youdont need a lawyer you can go to the court house and file for yourself. there should be an area for family law and they will give you papers to fill out and have noterized and filed. you may however have to serve him with the papers or pay to have them do it for you .
 
I'm in New Brunswick and used a lawyer since I wanted the custody stuff deal with too. My best friend is an RCMP officer and told me that if my ex took my son and refused to return him, we would need to wait for an emergency court order to get him back.

You can file online. I know NB has a family law website with the forms you need. My lawyer was awesome though, I paid $500 (through a payment plan) to him and my ex got stuck with the rest of my fees. He knew I would end up with back support and my ex was garnished through the courts.

FYI - Support Payments DO NOT guarantee visitation! Don't not apply for support payments because you think that he will get visitation, he could get it even if he doesn't pay.
 
The courts don't look at support and access at the same time. My son's father was so far behind, he lost his license but could still access him if he wanted to.
 
yes however its take ALOT for the courts to completly take away visitation. unless the dad is a child molestor or has hurt the child they wont take away visitation if the dad wants it. However if you have concerns for the child safety they will make it supervised, but they never flat out say you cant see the child. A friend of mines child still has visits with her dad even though he is a crack head and know gang affliate.
