Equal Pay

Hi, just a quick question. I am going back to work in 3 weeks and my boss has changed my job against my wishes. Apparently he is within his rights to do this according to ACAS. This is another story anyway.
The job he has given me is going to be, in his words, a "job share" with another girl who is about 6 months older than me, has worked with the company a few months longer than me and who has finished her NVQ level 3 where I am half way through it.
The job share will be an admin post, she will do the job for 3 days, I will be doing 2 days. My question is, as I am currently on min wage and she is on a higher wage than me, should my wage not change to reflect hers? If we are doing the SAME job, should I not legally be on the same hourly rate as her?
 
If it is the same position I would guess so. But, they might be able to get round it by taking into account experience/quals. But there shouldnt be a HUGE difference, like say you on 10k a year and her on 16k etc.

To be honest, i think your boss is lieing about talking to ACAS, just because you return after having a baby doesnt mean your job can be changed without your permission.

Secondly, Equal pay/Equal rights only applies if the two people are;

I) Doing the SAME job
II) Doing the SAME work in that job
III) Have the SAME title eg. Both customer service advisors.

If these are the same, then i would definately take this up with your employer and also seek legal aid from Citizens advice/ACAS or a work union.
You have a very strong case and backing if this is the case.
