Family to Receive $1.5M+ in First-Ever Vaccine-Autism Court Award

The first court award in a vaccine-autism claim is a big one. CBS News has learned the family of Hannah Poling will receive more than $1.5 million dollars for her life care; lost earnings; and pain and suffering for the first year alone.

In addition to the first year, the family will receive more than $500,000 per year to pay for Hannah's care. Those familiar with the case believe the compensation could easily amount to $20 million over the child's lifetime.

Hannah was described as normal, happy and precocious in her first 18 months.

Then, in July 2000, she was vaccinated against nine diseases in one doctor's visit: measles, mumps, rubella, polio, varicella, diphtheria, pertussis, tetanus, and Haemophilus influenzae.

Afterward, her health declined rapidly. She developed high fevers, stopped eating, didn't respond when spoken to, began showing signs of autism, and began having screaming fits. In 2002, Hannah's parents filed an autism claim in federal vaccine court. Five years later, the government settled the case before trial and had it sealed. It's taken more than two years for both sides to agree on how much Hannah will be compensated for her injuries.

In acknowledging Hannah's injuries, the government said vaccines aggravated an unknown mitochondrial disorder Hannah had which didn't "cause" her autism, but "resulted" in it. It's unknown how many other children have similar undiagnosed mitochondrial disorder. All other autism "test cases" have been defeated at trial. Approximately 4,800 are awaiting disposition in federal vaccine court.

Time Magazine summed up the relevance of the Poling case in 2008: ...(T)here's no denying that the court's decision to award damages to the Poling family puts a chink -- a question mark -- in what had been an unqualified defense of vaccine safety with regard to autism. If Hannah Poling had an underlying condition that made her vulnerable to being harmed by vaccines, it stands to reason that other children might also have such vulnerabilities."

Then-director of the Centers for Disease Control Julie Gerberding (who is now President of Merck Vaccines) stated: "The government has made absolutely no statement indicating that vaccines are a cause of autism. This does not represent anything other than a very specific situation and a very sad situation as far as the family of the affected child."

You're welcome! It just seems so important to be current on issues like this because we all have or will have babies. All I can say is parents need to know the risks of diseases and the risks of vaccines. Everyone should do their research.
 
They removed Thermosal has been removed from childhood vaccines for years and autism rates have not responded. If anything, they are still going up.

The girl had catch-up vaccinations which is permitted and it is safe for most people, but by having so many shots at once they risked more possible reactions.
She had a high fever as a response to all those vaccines. High fevers in young children are dangerous and can set off or accelerate underlying conditions like she had.

So I think the most important warning to take from that story is that doing 9 vaccinations at once can be risky.

Thats how I see it anyway.
 
I agree that 9 vaccines at once is bad! It always concerned me when Paul Offit claimed that a child could get 10,000 vaccines at once and be fine. Clearly, this would not have been the case for this little girl. Thermosal is still in a few vaccines and aluminum has taken it's place in many others. Aluminum can also cause problems such as these. This court case is a huge victory for the family. I am so sad their daughter was injured by vaccines but I am so happy they won the case.
 
Also, while this is tragic for that family, it does not mean that the same result would happen to anybody else. Millions of children are vaccinated every year and have absolutely no issues.
I know its hard as a parent to decide if its worth the risk, and its a personal choice.
But one person's bad luck or set of circumstances does not mean you would have the same problem in their shoes. There are no guarantees either way, but vaccine injuries are rare.
 
But it's still very important to know the risks of vaccines. And the article explained that there are approximately 4,800 cases awaiting disposition in federal vaccine court. I wonder how many other parents and individuals are going to stand up and speak out now. I know there will be false claims...on other sides...but I also know many parents and individuals have been too afraid or intimidated to speak up even when their situation is legitimate. I hope this will change that.
