How to deal with Debt Collectors

Hey all,

I'm looking for some advice. I'm really not good with money things, and now I'm being threatened, and I'm getting really quite worried.

I went to Uni years ago, and got myself a hefty overdraft (£2000), interest free, which I ended up maxing out. I was repaying it, cut it down to £1500, and then managed to pay the whole thing off.
A couple of years ago a 'friend' took some money out of my account and put me back into the overdraft. By this point I was in a very low place, on JobSeekers, and the overdraft got used. Once I was in deep again I got a letter from my bank that they were increasing the interest on my account, and things really began to pile on. I went to CAB and they got my account frozen for me. The bank however refused any repayment plan, and passed me onto a collection agency.
After a bit of argument with the collection agency, I got passed on to a collection agency (Yup, the first got nothing so they passed me on instead).
When I was contacted by the new agency they wanted me to pay them £1900ish, and that would be it. When I explained that I most certainly did not have anything of the sort, I was told that it would be £2300 on a repayment plan of £50 a month. I said that I couldn't afford that, and would have to get back to them regarding my finances.
When I next spoke to them, after my payday I explained that I couldn't afford anything of the sort. I'm single, living on my own with extortionate rent (another story), have bills to pay, and have child maintenance that I should be paying. My daughter is now 2 months old, and as yet I have never paid anything towards her as I can't afford it. Her mum has been very understanding, but still it makes me feel crap doing nothing for her.

I tried to explain these situations to the Debt Collectors, and they said they would revise the payments, after I'd made the first payment of the £50, and the following months one too since they were delaying it.

Now this morning I have had a call from them again, telling me I need to pay the full amount. Because I told them I couldn't pay them that when I got paid, they have dissolved the agreement.

As I said I'm living on my own, and only in part-time employment: 16-20 hours a week, at £6.25 an hour. I am looking for a better job, but obviously it's not easy. With my rent and bills I am already down to very little money, and that's before travel and food costs. I calculated everything in an excel spreadsheet, and according to that I'm going to need another £10-£15 a month to have nothing, without being threatened by collectors.

Now I have no doubt there are many people who have been in the same or worse situations, so I'm looking for any advice I can get. If anyone can tell me anything at all, it could really help me out.
 
I don't know much about this, although I've got myself into some bad situations with money before. My advice, Pay what you can as often as you can. You've obviously tried to come to an agreement.

Are you claiming everything you can? Housing Benefit, Council Tax Benefit etc..

Have you called Citizens advice? Maybe someone can help.

maybe do an income&expenditure form to prove how much u can pay. Do you have any assets? (own your own home with equity, ect) I assume not as you said you were in rented, if they know you have no assets it would be a waste of time taking court procedings against you as it is likely to cost them a lot of money which they are unlikely to get back. Anyway, ild say ts worth doing an income&expenditure form and making them an offer of whatever you have left (say £30 per month, dont set so high you cant stick to it, but dont make an offer they will laugh at). If they dont accept it go to a debt management company or CAB and they can deal with them on your behalf. good luck.
 
I think you would be better putting it all in writing, explaining your current situation in a letter and enclosing an income and expenditure. Suggest an amount that you can pay and maybe agree to review it in 3 months, with the potential of increasing your payments if you have found a better paying job.

I'd also get in contact with cab or the job centre to make sure you're getting everything you're entitled to.
 
Ok, cheers guys. I have tried Citizens Advice before, but became one of those people that were forgotten about as the person dealing with my case moved, and it wasn't picked up by anyone else. I will try again, to get this sorted, because now I'm getting all too worried about it.

You could also try the CCCS - I have found them to be great.

I don't know why creditors think they can bully people into paying more than they can afford, it is so pointless.

Hey all, just a small update.
I went to CAB yesterday. I spoke to someone briefly, and explained my situation, and have been told not to worry. There is nothing that the collection agency can do legally, because my debt isn't high enough. I've been given a couple of forms for them to figure out if I'm getting everything I should be, and to figure how much I can actually afford, but in the meantime I've been told to just tell the company I can't speak to them and hang up. Sounds fair to me.

Laucu: I'll have a look at CCCS. Just need to get some of the details for myself first. Actual amount of stupid rent for instance.

thats why they go on more and more when ur debt isnt high enough there not guna take u to court (cost to much ) and just go on and on and get what they can, dnt leave ur self short, give bk what u can, dnt worry bout them there certainly not worried bout you :hugs:
