Landlord down as living here?

So basicully, i moved to this flat in feb, i was claiming housing benefit wasnt a problem at the time

now ive started working fulltime, im entitled to some help from them..
anyway, they stopped my claim, i went through to re apply for this, now the council want proof of everything from my landlord.

i dont even have a proper tenacy agreement, when i moved here he gave me like a piece of paper he wrote their and then! i dont know where that is now, but i didnt get anything proper..

where do i stand if my landlord is down as living here? as i know this address and the account i pay my rent into is a ladys not a mans name..
 
he's probably dodging the tax office! by the sounds of it.
i would try and get a proper tenacy agreement put into place. you're going to need it for housing benefit :(
either that or give citizens advice a ring. they'll guide you. x

do landlord get taxed then? i dont want to text him, he didnt know i was claiming housing benefit before, he assumed i worked! x
 
yeah, renting properties is classed as a second income. :flower:
so they have to declare it for tax reasons. how did you claim housing benefit before hun with no tenancy agreement? we got given the third degree when we went in to claim ours lol!
 
i had some paper he gave me with the name its in, the price i pay a month, address and my name we both signed it, when we was giving him the money and asked for an agreement he just ripped a page out of a book! .. anyway, when i took it to neighbourrhood office they said it was fine because it had amount and stuff on x
 
He may be doing it to claim rent a room allowance through his tax return!
 
two reasons landlords do this

firstly -to avoid paying tax on the rent (however the income can often be offset against the morgtage intrest so totally pointless!)

another is down to the fact most dont have a buy to let mortgage.. lenders tend to charge higher intrest for BTL mortgages.

i would go to CAB you may find council wont accept that as a tenancy agreement..

did you pay a deposit?
 
Also another reason is if they have a partner and children they can claim income support/benefits ect and he can claim he's living at that other address! Very common these days !!

And he has a wife + kids I think

I'm going to text tomorro tell him I need tenancy agreement and everything I need in it.. If I'm recieveing letters to my address about them remorgaging this.. Is that normal? Surely they have there own address 4 that!!
