Hi All,

Just after some advice as to what to do- i was due to start my ML on the 31st of March- however i have been suffering with sciatica and have currently been signed off by the doctor for the last 3 weeks. I know im not going to be able to work the last 4 weeks so i asked my boss if i could take my ML early rather than keep getting signed off. She has spoken to HR and advised this is possible and i have a meeting arranged to discuss my final figures etc. Did anyone else have to move their ML date forward?? I just thought it would be easier for everyone involved if i took my ML rather than continue getting signed off as i know i wont be going back!!
Im being made redundent on the 31st as well so my finall figure will be all my ML minus 3 weeks plus my redundancy in a lump sum?? If i go in and they try and screw me over can i just stay signed off by the doctor????

Any help gratefully recieved!!

I went sick hun knowing that they cannot make me start my maternity leave til I am 36 weeks,so if you are getting paid and not going back there why dont you just get note to cover you til you are 36 weeks I would benefit myself not them
x

Honest just stay off with doctor makes it much more clear cut and easier

Hi Catkin, sorry you are having problems at work. Your employer cannot legally force you to commence maternity leave any sooner than 36 weeks (and only from 36 weeks if you are signed off work with a pregnancy related illness). Why are you being made redundant whilst on maternity leave? Is it an entire business closure? If it is not and you have been hand-picked to be redundant, you may have a case against your employer because your position is protected if you are of maternity leave status. I would urge you to get in touch so that we can discuss your options in further and confidential detail, you can contact me through our website Babylaw.
