Hello, need a bit of advice, I applied for a new job while on Maternity Leave as the job I'm in at the moment just doesn't fit in with family life anymore. Now I was due to go back mid November however my new job will be starting around October (no confirmed start date as of yet). Just needing a bit of advice because I don't know when to inform employers without putting me out of pocket. Will I owe my employers any money, it's SMP I'm currently on? Will they owe me anything for Annual Leave I haven't taken since I won't be returning? Thanks for any advice :) x

You just need to give your usual notice (so whatever your contract says). If you are only in receipt of SMP then you will not have to pay any of this back. If you decide to start your new job before your SMP ends, then you won't receive whatever was left, but obviously you'll get your normal wage instead.

You accrue annual leave whilst on mat leave, so they will work out how much annual leave you've accrued until your leaving date and then they will take off anything you already used before your mat leave. If they owe you any holidays then they will pay this to you in your final pay. Be aware however, that if you used lots of holidays before your mat leave there's always the possibility that you've used too many holidays and they can deduct money from you.

Thanks for the advice :) I will be giving them notice as soon as the details of my new job come through the post so excited to start :) x

Hi this is the same situation I'm in. I've just given my employer the required months notice as I strt a new job at the end of October and my SMP runs to the middle of November. My old job are just stopping my SMP payments when I start my new job - I told them on the letter when my new Job starts. You will also received any holiday pay you have accrued up until you leave.
