Hi, does any one have any information on overnight access for a baby? I have heard I can stop him getting over night access to her until she is four. She is currently 14 months, her father never lived with us and she has never stayed over night with him before. He has her twice a week for seven hours at a time. The reason I don't want him to have her over night is because I feel she is too young to understand what is going on and it will disrupt and upset her. And my ex also threatened to kill me and has since threatened my friend and family. I would be so grateful for advice.

if it went to court, the only way he wouldn't be allowed to have your LO overnight would be if you could provide proof he threatened you/police reports .. If the police werent involved its more than likely the courts will grant him overnight access.

Although if u say u want lo to be in a route. Letting the baby ESP young baby house
To house isn't giving them stability!!

The age of four had been getting lower and lower, i dont think in many cases the age of the child matters at all. What matters to the court is how often, and how strong the relationship is between child and parent. And like a previous poster said, if you have no proof of the threats (the only proof that is accepted will be police records) then unfortunatley, if he took you to court, he would most likely be granted it.

xx

Thanks guys, I reported both incidents to the police and they kept a record of it and I kept the messages on my phone, would the court take that into consideration? Xx

police reports yes, text messages is abit iffy. They dont really use them as evidence, nor do they use diaries. They may read a few but they wont make their decision based on them. The onlyy thing you can rely on what the courts will use when making their decision is the police reports hun. Shitty, i know :( but if you have them you should be fine :hugs: x

Thank you! I was just so scared of him getting her over night at a young age, but as I have the police reports I can sleep a bit easier xxx
