Maternity leave can now be split between parents, and so both can take SML and receive SMP (at different times). The only proviso being that the other party needs to be going back to work.
I.e. A woman could take off 8 months instead of the full amount, receive her SMP, then return to work, and her partner could then take the remaining paid month of SMP and unpaid three months leave.
There is no limit to what each can take within the year so the man could take all or some leave and vice versa, just the other party goes back to work. Its called additional paternity leave.
I have just read that it is restricted to 6 months.
