I really really need help ..... I'm confused to what I'm entitled to. My SMP does not cease until 25th July. I'm already 10wks pregnant. I have to inform my employer by 15th July I've requested to return and use my holidays so I work 2/3/4 days a week from 18th June ... I've been to seek advice from citizens advice and they tell me if my employer has no small print or additional policies in my contract or their handbook (which they don't) I'm entitled to everything again as long as I inform them in time. Now I've been asked to go for a meeting a week today, they don't know I'm expecting again, I am concerned so I've tried to do more research. The 6 weeks 90% pay is the bit I can't fathom out..... Is this 90% of my salary regardless of my maternity leave or is this 90% of what I earn between wk 18-26 of this pregnancy. Desperately need some advice.

How your average weekly earnings are calculated

To qualify for SMP your average weekly earnings must be at least equal to the lower earnings limit (LEL). The LEL that applies to you is the one which is current on the Saturday at the end of your qualifying week. The LEL changes every year. The LEL is £102 a week in the 2011-12 tax year.

To calculate your average weekly earnings your employer will average your gross earnings over a period of at least eight weeks up to and including the last payday before the end of your qualifying week. The qualifying week is the 15th week before the week your baby is due. This period may vary depending on how often you are paid – weekly, monthly or other intervals.

For working out SMP purposes, ‘pay’ means gross pay that is due to you before any deductions. Your employer will take into account your gross pay that you received in the set period, as long as it counts for National Insurance (NI) contributions (or would count if you earned enough or were old enough to pay NI contributions).


it is an average of the qualifying period which will include SMP depending on your dates (ie what's in bold in your OP)

I would say your employer might try and give you your current pay rate (ie mat pay) if you haven't returned to work before the qualifying week
