Restructure at work and flexible working request

I had my flexible working request approved to work 3 days last year. Just before I went back to work after maternity leave a restructure of my department was announced and my director allowed me to work 3 days a week for the foreseeable future until the restructure was finalised so I didn't miss out on redundancy money if I was made redundant.

My current job is to be deleted and I am ring fenced for promotion but have to go through an interview process but am guaranteed a position. My employee is aware of my wish to go part time but the jobs I am ring fenced for there is no detail if these are full or part time and I am told the decision is based on business need.

If they decline me working part time and I have to work full time I have no child care until a place arises at my childs nursery (likely 6 months) will my employer have to compromise as they have put me in this position?

Secondly as they have not advertised positions as full/part-time can I use this as evidence in appealing a flexible working request?
 
As far as I'm aware, they would not need to compromise anything as it is all business need and so if you can't meet the need then they would employ someone who could, as harsh as that sounds. Plus restructuring of a company usually means that a lot of redundancies are made to make way for whatever the new structure would entail - my company has just done the same thing and all "team leaders" we're told that they either needed to step down to general assistant (and take the pay cut and new hours allocated) or take a redundancy pay out.

I would personally ask whether the position is full time or part time before going through the process so you know where you stand - I'm not sure if you could use this as an appeal if the decline a flexible working process as, again, it will be "business need" which is how companies get away with a lot of things. I was rejected a flexible working contract because of "business need" which could have been flexib,e and moved slightly but they stuck to their guns, it's crap! They may also tel, you if its full or part time in the interview - if you've gone for it knowing you can't work full time it might be a bit of a waste of time?
