I hit the breaking point of my relationship with FOB and want to move to another state. What legal actions to I have to do to cover myself and my daughter. I don't think he will fight for her but in case he does.

You can legally move out of state but he can file & order the child to be returned to the state. If he files for, and establishes paternity, he can then file for visitation. You would be required to show that your reason for moving out of state is of more important for your child than a relationship with her father. If he fights it, and you stay out of state, you can lose custody.

There's really nothing you can do to cover yourself except hope that he agrees and doesn't fight it.

aliss is right...the good thing helping you out is that LO father would have to hire an attorney to fight for visitation which costs moolah!! so if he currently isnt involved and/or paying child support then chances of him paying to get an attorney to fight for visitation is small...hope everything works out. my sons father lives in another state and I often wondered if he would try and take my son but 5 yrs later I dont worry anymore...my lo father lives in the same state, I am more worried with him because he has already told me that he doesnt like paying child support and not seeing his kid...he makes a lot of money so paying for attorney wont be a problem for him...I am already getting mentally ready for battle....
