smp and holidays

I was only entitled to smp with work and I'm planning on handing in my notice. I know I still accrue holidays whilst on maternity leave, I'm just wondering if I'm still legally entitled ot them if I voluntarily hand in my notice. If not, no biggie I was just wondering.
 
yes you are!
even if you quit your job and have some outstanding annual leave you are entitle to it.
if for example:you worked full time and your yearly annual leave allowance is ex.lets say 30 days and you didnt use any of it they should pay you for it or you should just have holiday.
if as you said you planning handle your notice point your annual leave in it.like:please work out my outstanding annual leave.or something like that.

I work full time. I know my holidays expired last june and I accrue 1.75 days a month but overall I know that is equvalent to 5.5 weeks as it states in my contract. Thank you. I don't know how many days I am entitled to lol x
 
5.5 weeks is probably 28 days. What I would do is write a letter saying that you would like to officicailly return to work from ML on x1 date, but regretabbly you wish to immediatelt hand your notice in and use your accured holidays. I believe I had x2 days annual leave to take prorata'd from 2011 and 2012. I work this out to mean my last working day would be x3. Please can you confirm this and the receipt of my notice.

X1 = day after SMP finishes
X2 = number of days you have left from last year ( if any) and pro-rated this year.
X3 = you can work out.

Please note this is based on you sending the letter sooner that your notice period. I would recommend at least 8 weeks before you want your holiday to start. That's the notice to come back we have to give otherwise they assume you are taking the year off.
 
That's brilliant. Thank you. I shall be sending it on monday. But my employer is very difficult. Our hour department is non existent.
