Bank Issue/Direct Debit HELP!!

i told the bank on the 25/08/09 that i wanted to cancell ALL direct debits. she printed of some form and i signed it to clarify she told me 2 let the companys know to. So i do online banking and checked and one wasstill left so i cancelled it. well i check my bank on 2nd sept (online) WELL WADDDYYAAHHH NOOOO?? im overdrawn £144 and all my deirect debits have been paid. my over draft limit is 100so when its unarranged u get a charge of £35. so thats now gone up to £179. but wait thats not it, insaurace (7.99) then came out on top of that and cause i was overdrawn in a non arranged over draft when the money was due to come out they charged me the extra £35 AND A £28 fee as i was already in a unarranged overdraft.

so watdo i do im goin the bank in the morning as i assumed there was some glitch but then i got the letter in the post on saturday, it kind of acame tru i cant fone the 0845 number and i dint cancel the direct debit with my mobile companys cause when i talked to the man he said untill my bank refuses the payment i cant change/stop direct debit.

will i get the money back and not have to pay them does anybody kno? as its £98 JUST in fees, & Quite frankly IM BROKE!:cry::cry::cry::cry::cry:

PLUSSS i told the bank know matter what if the money isnt in my bank dont pay it 4 me just leave me to deal with the companys, the ladie said she put eh block on it so my bank would refuse if i didnt have every penny it wanted, so i dnt get it :S

It could be that some banks take 5 days or longer to cancel direct debits - well 5 WORKING days, so that would mean that if you signed the forms they would be cancelled on the 2nd, BUT they would already be in process from the morning of the 2nd - as they seem to take money out your account before they apply any changed or credits.

But deffo explain to them that you have NO money, and will have NO way to pay the charges etc etc. If you are on benefits my sis said something about them not being allowd to take that money from you as they MUST leave you something to live on, $470 a month or something like that.
 
I bank with Natwest and they did something similar a couple of months ago, I asked them to cancel a specific direct debit (plenty of time in advance) and it got paid and took me overdrawn so I got charged. I called the branch (using the 0845 number because they're included for free in my phone package) and explained the situation and they were very helpful and actually refunded all of the charges and put a note on my account not to charge me the following month if I was still overdrawn because it was their error.
 
When I opened my bank account and also told the person that I wanted an account where the money wouldnt come out if I didnt have any...And it did and I didnt notice for weeks, BIG BIG BIG overdraft repayments for me.

So I moved to a bank where the money deffo doesnt come out, I tried it at the shop my sister works in so I trust them!
 
type say no to 0870 in google then type that number in and itl give u a free number to call hope it helps n u get ya money bk xxx
 
This happened to me with natwest, I cancelled a direct debit with them but as i didn't contact the company they still requested the payment & apparently this is how it got paid -

Each DD has a ref number & when the bank cancelled my 1st one. The company just resent a new DD with a new ref number as i'd not told THEM i wanted to cancel so they were under the impression it was still to go ahead.

I didn't think this was allowed as i didn't agree to it but it seems it is allowed as i agreed originally to a DD & hadn't told them no since if ya get me.

I didn't have an overdraft at all so the money was paid out making me over drawn then the unagreed overdraft charge was added. I complained that if i didn't have an overdraft at all then they shouldn't of even paid it, They allowed me to go overdrawn so i didn't feel the charge was fair. I stopped using that particular bank account & got all benefits stopped from being paid into it until they sorted it which they didn't so now i use my natwest reserve savings account as a normal bank, I am about to switch everything to abbey national because natwest are shit heads.

So check that ref thing out hun, That yes a bank can cancel a DD but the company can still call for it & it be paid, Annoying isn't it x

If the money you get pain into it is benefits then the bank can not take charges from it x

That isn't allowed - when originally setting up a DD payment, the company has to have your consent for them to go into your account & take the money, this used to be by a signed DD mandate, but consent is usually given over the phone or online nowadays. Once the DD is cancelled, so is all consent, so they can't just resend a new ref number as they haven't got your consent to do so. If a payment is taken in error or without your consent you are entitled to a full refund of the money taken, from the bank itself under the DD guarantee.
Oh & once the payment rejects due to the cancellation, the bank lets the company know that the DD has been cancelled.
 
hey hunny did u get anywhere with the bank??? im with natwest and get this all the time... i fecking hate that bank!!!! xxx

This is what i thought originally , but was told i should of cancelled with the company directly as they still had my verbal agreement to take the money. The company had consent if you get me but the bank was told to cancel, The bank are at fault totally , wankers they are .
Yep i've always known that banks then return the payment as DD cancelled but they obviously only do this as & when it suits them eh x
 
I swear it depends on the type of day the person you speak to is having... sometimes you'll call and they'll be fantastic, other times you'll call and they just don't care and make you want to scream at them lol.
