So I was told I need to have FOB's consent to put him in bc, but then told if I don't put him on I have to pay for paternity test since I'm the one who didn't put him on, it'd be like I was the one denying he was the dad. I want him on there for many reasons, but which is it? Can I or can't I put him on? I'm in Ontario, Canada.
 
I'm in Canada as well and when filling out the paper work for my 2 kids i need my husbands signature on his part of it. So i think that falls under needing his permission as he has to sign it. Also i have no idea about the paternity test but i would guess that it would be the person who is requesting the DNA test would have to pay for it. Sorry if i am not that much help
 
Grrr. Stupid exs making paperwork complicated. I haven't seen or spoken to him since January, he lives on the other side of the province.
 
i had one kid in sask and two in alberta they were the same the father had to be there to sign unless there was extenuating circumstance like he was deployed in jail ect. as for the paternity testing it would be on him to prove he was not the father. Weather his name is on the BC or not it does not effect child support or custody ect. (at least not in alberta) If he denies paternity it is up to him to get the test. But if it comes back that he is not the father you would be responsible for the cost. when i went to court it was never an issue of me having to prove my kids were his he was the one who had to prove they were not. and i never had to pay for any testing.
 
oh and most family lawyers will give you a free consult on what your rights are and what course of action you should take. give you the info without actually having to pay the retainer until you need to.
 
You don't need his consent to put him on and it would be helpful if you did when you went to court, there will be a DNA test either way and you have to pay for your portion of it but if it comes back as his then he has to pay it back, I hope this helps
