Has anyone had to go to court with the CSA for child maintenance

Has anyone had to do this?

This I fear is going to be my only option and OH has already said that.

He earns £350 a day and is saying he will never pay a penny. He has said he will see me in court.

I am just wondering what everyones experience of this is?
 
Have you seen a solicitor?

Go and see a solicitor and they will advise you about CSA as well as any suggestions about him seeing your LO.

He is probably just saying that hoping you won't bother and he can keep on spending the money as he sees fit instead of providing for the child he made with you.


Hope that helps, I'd definately start at the solicitors and they'll give you advice about it all. Depending on your income you may be entitled to Legal Aid.

I dont think I will be entitled to legal aid but agree is the best step forward

I refuse to let him avoid his responsibility
 
My ex to my first DD refused to pay so they arrested his wages. The money is sent to the CSA by his employers before he gets his wage x
 
The CSA are PANTS!!!!!

They have told my OH that he is £850 in arrears when he has been paying consistently! He has asked them how exactly the arrears have accrued and they won't tell him! Now they're saying he's non-compliant even tho he hasn't refused to pay, he just wants to know what he's paying for (rightly so imo. They can't just demand extra money without explanation)! And they're threatening to take him to court or take his passport or driving licence.

Not many of them seem to know what they're doing! Lol I'll stop ranting now hehe :blush:

The CSA do have the power to deduct payment direct from his wage each week (D.O.E). Have they not mentioned doing that?

There are quite a few websites that can give you info on how it works etc. The only one I can think of at the moment is www.afairercsaforall.co.uk

It makes me so angry to see so many men avoid their responsibility, where the parent with care is screwed over by the system as the CSA don't follow it up (this is happening to my best mate atm).

Then there are people like my OH who are willingly paying the CSA but are being screwed over by demands for more money with no explanation!
 
I've had problems with the csa ever since my son was 5wks old & i told them about his dad, he worked & refused to pay a penny always found excuse after excuse to keep them at bay, they did start taking it from his wages but he just left that job as usual & moved onto another job etc , Soon as they caught up with him he just left & moved, I asked how many times he was clearly allowed to get away with this & they kept mentioning taking him to court but it never happened, i started pestering about it & was told the next time he job hops they will take him to court ..inbetween can i say 3yrs passed & several more job hopping... He was working & claiming jobseekers dole but still paying nothing so i grassed on him & he got caught :)
Since then he hasn't worked since & i don't think he will as he now gets his rent paid & gets paid £60 odd quid a week to sit on his ass. The csa have constantly said its down to me to keep ringing them !! I've phoned them countless times with new job info & each time he rings to make an agreement to pay they have to allow him 12wks to do so !! Giving him 12wks free money before he moves on, When i ring for the last 8 mth all i get is your case has gone to the " complex " team & as yet nobody can help you, Or i get someone will call you back or its in the " admin " team & there isn't even a team set up to deal with it !!!
I'm really really pissed off with the csa for letting him get away with it .

Oh god im worried now, i will have to take the babys father to the CSA cos he said he doesnt intend to pay me a penny r speak to me ever again... i hpope they get me some money!! i know someome who had to wait almost a year but now get s a fairly good amount fromthe babys dad each week thru the cas staight from his wages.
 
Mines is going to be a nightmare I can tell.. He's self employed so going to try every trick in the book!

I've got a looooong road ahead of me I tell ya!!

I'm up for the bloody challenge though - there is no way he is getting away with it!

My ex did a similar thing with constantly changing jobs then he became a student so didnt have to pay me a penny, although whilst he was in the jobs he built up a debt to the csa (me) of £4,000, after a long slog and I got my MP involved as things were not progressing the csa enforcement team took it to court to get the debt registered, he still refused to pay so bailiffs were instructed (bearing in mind he is re-married now and has no financial worries of his own) as the house is in his wifes name nothing can be done about that side of things but I have had the bailiffs collect some money, although he is stupid cus they put their cut onto it also so will take him longer to pay it off!!
He has nnow started working again on the 18th March, I have rung the csa 3 times since then to find out what is happening about a new assesment and been fobbed off each time, after speaking to them again today it appears that the forms were sent out to him at the end of april (why so long I dont know) and he hasnt returned them, so could be going down the same long route again.
Sorry for the long rant, and I feel for the fathers that do pay of their own will but get tarned with the same brush, but for the ones waiting and needing the money it is hard x
