Evening ladies, How are we all doing? I wondered if we have anyone on here that is studying law? I am having problems at work, My boss who is also a close friend has slipped out to the directors last week that I am under the hospital and trying for a baby! They have had me in the meeting room today as they are demoting me and cutting my pay as they say I am not giving my job 100%!!!! I am in total shock can they do that??? I know it has something to do with me trying for a baby I just know. x

Wow that's shocking. I don't know what to say I hope someone has some advice that sounds like discrimination to me!

Hey Yomo

If your boss is willing to admit in a statement that she informed the Directors that you were TTC and also what was said in this meeting you should definitely seek advice from the CAB.

They will have to prove that you were not performing in your role to justify their decision. Have they given you any verbal or written warnings regarding your performance previously?
x

Shocking and definitely against the law if it is as a direct result of you TTC! As Rachelle says, have you been subject to any other disciplinary action, even if it is a formal chat followed by an email? HAve you missed any targets or failed to deliver on any tasks set? I would DEFINITELY contact the CAB initially and then a decent employment lawyer...

Hi hon
I'm not trained in law but my job does involve giving out advice on employment legislation and this definitely sounds like discrimination or unfair treatment to me.
Although you are not actually pregnant yet (as if you were you would be covered by maternity legislation) you are effectively being told that you are being demoted because of your desire to have a family. They aren't allowed to do this. They cannot treat you worse because you want to have kids.
If you were at a job interview for example, they cannot ask whether you plan to have children as this would be discrimination. I don't think that this is any different to that.
The hard part would be proving it as it might end up your word against theirs.
Please call ACAS on 08457474747 or visit www.acas.org.uk. They are really good on this kind of thing and will be able to give you much more info on your rights.
Good luck!! Let us know how you get on

xxxx
