Hubby's been suspended....... UPDATED Appeal on Friday! PMA needed!

Oh no! Have the company not been a bit harsh, or are they needing to cut costs by getting rid of people so when situations like this happen they use it to their one way?

Will you try to appeal?

Hi hun, I'm so sorry! Your hubby deffo needs to appeal as I don't understand how it's gross misconduct. Don't let this stress you out and I know it will. Let us know how he gets on.
 
Thank you so much ladies...... we have spoken to the union (who also can't believe it) and they have put in an appeal - they also mentioned that 2 other drivers who have had blameworthy accidents (worse than my hubby) and injured people got their jobs back after an appeal, so I am quite hopeful on this, but in the mean time we have no income and have got the next week or so of worry. The union also said that they are trying to make an example out of him. So unfair! :growlmad:

I will let you know next week as soon as we get the outcome of the appeal.

Hubby's appeal date is this Friday at midday...... not sure whether to feel confident or not :nope:
In some ways, it is really obvious that this is all unfair and over the top - especially as the witness statement and police report was not taken into account before the decision to dismiss was made!
In other ways, I know that this is a big company and there is a lot of backstabbing that takes place :growlmad: I just hope they have a compassionate bone in their body!

my hubby is also a bus driver and he had a woman swerve out in front of him on a very narrow road; causing him to scrape into a parked car (which already had damage from a previous accident); some malicious so and so was on the bus seemingly a nosy member of joe public and he came out and started taking photos of damage that was already on the bus and this damage even noted in the stuff they have to fill when taking the bus out of the garage, but still my husband got called in for disciplinary, my husband is an excellent driver and when working for a previous company he got a special certificate from the DSA because one of their teachers got on his bus and was extremely pleased with how he was driving. My husband got put on 18 month probation with his work but most people in his garage are for some reason or another. If you're not in London its very very unlikely your husband will be sacked; if you are in London unfortunately some companies are looking to get rid of long-standing workers purely for profit reasons, new workers are not subject to the same job t&c as the old ones and they can get away with paying them less as well (and TFL are putting pressure on the bus companies to be more 'efficient'). Still my BIL worked for a company like that, got into several accidents, hit a cyclist (not his fault but still potentially very serious) and got suspended several times but he wasn't sacked. The company director has decided to keep the decision of dismissal, although the union didn't think they were very fair as they used all the evidence against my hubby, yet they didn't take into consideration his long service or his excellent driving assessments, nor did they take much notice of the witness statement. Their words were "we don't think training will rectify this issue" - Well, I'm sorry, but to 'think' that and not give it a try IS unfair.

We are now waiting for a form to take it to an employment tribunal and hubby is looking for another job :cry: For the time being we are trying to keep positive - "one door shuts and another one opens" etc but it's so very hard :nope:
