If I die

I live in Washington and have spoke to a family law office and was told that I can name who will get my kids if I should die but I also need to say why. I need to list who can't have my kids and again why. The judge is more apt to listen to your request if you have good reasons why the child shouldn't go to FOB. As for me I really have no worries because my girls FOB has not seen or been involved with my girls in over 10 years. Not even a birthday card. The longer they go without seeing them the better. Shoot they even look at if they have paid any support for the child, on their own without DCS making them by taking money out of their check. They will also look at the fact that he didn't sign a affidavit of paternity. She is 4 months old now and they will wonder if he wanted her so bad then why didn't he stand up and take action to become her legal father. My oldest daughters dad didn't find out about her until she was a month away from being 8 and here the courts won't allow him rights to his own daughter because 1. I had got married 10 days before she was born and said that my EX husband was her legal father and 2. He waited too long after he found out via a dna test that he was her dad to try and get any rights. Oh you have to love our state. I do think it's messed up that they won't allow my daughters dad to be on her BC so she can get on his medical (he is in the army) and leaves a man that hates her on her BC!!! Anyways good luck in getting this sorted out and I'd say get it done asap!!!

i'm in washington as well OMGSH you just calmed SO MANY NERVES. I cannnnottt thank you enough for informing me of this... i have MANY valid, legit, strong reasons why she shouldn't go to him. I feel very comfortable now.. i will be writing a will ASAP... any family lawyer recommendations?? wow.. thanks again..

I don't know of any in Seattle. I looked one up in the phone book and called a woman..lol I don't trust males to take care of me as a woman. I am happy that you are feeling better. Beat of luck getting your will done. :hugs:

I know in the state that I am in if the Bo father goes to the court gets another dna test I think it is like $500 then they will remove the old name and add the correct name. I know every state is different but I hope that it helps also I don't know how the bo dad is but have you thought about just having him adopt your little one that way he has all the same rights?

that's not the issue at all, he's not on the bc and i don't want him on it. i DO NOT want him HAVING ANY rights under ANY circumstances if i can help it.. i was looking for info on making sure or at least making sure it was a good chance he WOULD NOT get her if i were to suddenly die... i think you just misunderstood lol :)

Sorry I think was replying to Wantingbbbump I am not sure but I had my ex sign a doc saying that he was ok with my son going to live with my parents and even thought he could change his mind I know his new wife would never allow him to heck she won't even allow him to talk to his son or me. I have to call his work if I ever need something. Thank God this isn't very often. But I would think that unless he fought you or your parents to get on the bc you should be ok BUT I am not a lawyer sorry also I think that if you ever had to go on any state aid they might ask who the father is and why he isn't on in it but again I only know what a friend went though when she lost her job :( Good Luck

Wow, that's ridiculous.... What kind of woman keeps a father away from his child... jelous much? jeesh.

It's not so much the bc that's my MAIN worry... just that i want my parents to raise her if i died. my moms only 34 my dads 36, they're VERY stable, great jobs, nice home etc. my mom's got a strong faith in God and i know they'd raise to her potential. unlike her bio dad. He doesn't even make any effort all he does is feel bad for himself, make excuses, and blame the world.. and gets his mom to back him.. he's got no plans for life, no motivation, no drive, no faith, he really can't even take care of himself. Never had a job, never leaves his house, nothing... I'd die a million times over if she went to him. x
