We tried to fight it, but they denied us the right because my wife isn't legally female yet, even though I'm legally male. They also informed us that in NJ, a same sex couple cannot be listed together on the certificate and one will be listed as "father" and whomever carried the baby will be listed as "mother". I'm sure you could go in afterward and adopt your baby, though.
