Male factor and Cryptorchordism (undescended testicle) - Legal Claim?

Hi,

I am new here and was wondering if anyone could help or advise? My wife and I have just gone through our first round of IVF+ICSI which sadly resulted in BFN. Having read the forums, we were prepared (to a point) for the emotional roller coaster and it was most certainly that.

We are now trying to pick ourselves up and dust ourselves off before taking a deep breath and probably trying again at some point.

My issue is that our reason for IVF is due to my male factor - sub fertility more than infertility, but v low count and poor motility. My doctor has said that this is almost definitely due to an undescended testicle during childhood. However this was not diagnosed until past 5 years old and not treated until nearly 10 years old (this was in the 1980's) Its now widely accepted that this is way too late.

Does anyone have (or know anyone) who has had experience in attempting to make a medical claim against the NHS for this? I am considering seeking legal advice but wanted to hear from others first.
