Hi

I am wondering if anybody can help me. I was made redundant 29th June 2012 and am now 17wks + 4 days pregnant and due 15th April 2013.
Can I claim for maternity allowance? I know I can't claim SMP as I am no longer employed.
I have looked on the net but none of it seems to make any sense to me.

Just wondered if anyone had been in the same situation?

Many thanks

Your test period is 8th jan 2012 to 13th April 2013.

You need to have worked at least 26 weeks in this period to be eligiable. As you were made redundant on the 29th June you have only worked 24 weeks so currently you will not be eligiable. I would suggest getting a few weeks work, even if its temp work so you will then make up the 26 weeks as they don't have to be consecutive weeks.

Also just wondering a friend of my dads has asked me if I wanted to do some part time bookkeeping (that's what I am qualified in before being made redundant) but on a self employeed basis. So I would give him a invoice each week for him to pay me. Would that count as working in my test period? To make up the extra weeks I am missing?

Any help would be appreciated.

Thanks Jem x

Yes it would but you would have to register as self employed and pay class 2 national insurance direct to hmrc. Earning would have to be over £30 a week and will be averaged out. You will also have to do a tax return every financial year until back on paye or when you stop being self employed.

thank you so much for all the information. Is their a time scale i have to work these 2 weeks i am missing? I am currently on jobseekers (sadly have to as i need to provide for a family) and will obvously have to stop claiming that so i can get back to work again.

Thanks again

Yes you would have to work the two weeks before the end if your test period, so basically any time between now and 13th April and you must earn over £30 a week and pay your NI. I would recommend that you do at least a months work, however to ensure calculations are correct and it counts as full weeks as my figures are rough and don't want to be held responsible if you don't get paid!! Yes if you work you will also have to come if JSA, it may actually be worth speaking to the job centre re the best way to approach it is.

For MA you only need to have earned for 13 consecutive weeks within that period. Not 26.

Ah, you confused me there for a minute..lol.

There are two rules you need to satisfy to get MA.

1) Employment Rule - Where you need to have been employed for 26 weeks (no consecutive)
2) Earnings rule - 13 weeks, non consecutive earning at least £30 a week.

So you will still have to do a few weeks work.

So do I need to still work those few weeks to get maternity? Am currently now registered as self employed as I have been offered some part time bookkeeping work. It's £35 a week for 3 hours a week as its only a small company.
I can try and get some more work (every bit helps before / after Xmas) but nothing as yet x
