You can also still get maternity allowance whilst you're working as it's paid regardless. This is what happened to me when I was pregnant with d/d before. Hope it helps.

From what I've read this isn't true and I don't know how you managed it!

You can work 10 'Keeping in touch days' but any more than that and your MA is affected. MA starts when you finish work and stops at 39 weeks or when you start work again, whichever is earlier.

I'm confused about this one. I have never had a job that has paid me enough to give NI contributions, and I finished that job in June. I'm unemployed and pregnant and also signed off with depression, so is there anything I can do to claim Maternity allowance?

Yes!!! I don't know how you managed that either!!!

You have to tell the DWP when you are going back to work if it is before 39 weeks. They will take into account 10 KIT days; that's the only occasion you will get pay and MA, if you are classign the days as KIT.

I got MA and pay for my first 3 weeks work as I was working 3 days a week so the 9 days were classed as KIT days.

You might have just got away with it!!!

if you can't get MA you may be able to get incapacity benefit if you are off work with depression.

Thats what i though but they phoned me yesterday and said they needed to know what date im leaving before they can send me my smp1. Ill give them a ring back and tell them to hurry up and send it! Thanks hun xx

That's so odd, did you get it sorted out?? I got my SMP form from my employer (temping agency) about 6 weeks ago - no where on it does it mention my last working day - and have only today been asked to confirm when I'll be finishing up working.

Have you earned on average £30 or more a week for 13 weeks in your test period? (the test period being 66 weeks before and including the week before the week your baby is due and you have to have worked for 26 of those weeks) If you have then you will be entitled to something.

No i phoned the agency again yesterday and the same person said she spoke to payroll for me last week and they said they shouldnt be sending it yet... when the hell will they send it then?? I told her to phone them again and tell them i need it as soon as possible and she said she will and she will phone me back today... i dont think they have a bloody clue lol x

Ah how frustrating for you and what a bunch of muppets!! When I got my SMP form from the agency it was after I'd spoken to them to see if I was eligible for Stat maternity pay. All they needed from me was my MAT B1 form, which i got back at the same time as the SMP form when they confirmed i wasn't eligible for stat maternity pay.

If you can't beat them, join them? Do you know when you want to finish up at work so that you can this form from them? Good luck hun!!!

well i would have worked up until October 11th (ish) when ill be 37 weeks but the contract i am on at the moment will be ending before then but we havent been given a date. I spoke to the agency again and they said i have to give them and intended leaving date so i just said October 11th. Its such a nightmare!!
