maternity leave, maternity allowence annual leave- do I get any???

Hi,

I am a private nanny work 20 hours a week over 2 days, i get maternity allowance. Not sure If that makes a difference.

From march 2011-march 2012 I had 14 days annual leave to take, i took 5 between march and aug, i was then off sick and got SSP, and didn't take any more annual leave as I was signed of with hyperemesis, i took my maternity leave as early as i could from 29 weeks from the 1st week of Dec 2011, as I though this was fairer on the nanny family rather than claiming sick pay ( I know they don't pay it it was statutory sick pay, so they claim it back, but I still felt bad for being off) I am going back to work on 4th dec 2012, returning to my 2 days 20 hours a week, am I entitled to any annual leave, and if so how much? i didn't think you accumulated annual leave when on maternity leave, but my friend said she did, is this right? But she got SMP so would it make a difference. If so how much will I have?My 14 days from last march till March 2013, or the ones from the year before? Or none? So confused!

who is classed as your employer??

if the family who you work for are your employers, they should be paying you SMP ( if you have worked long enough for them) withpaid accrued annual leave to add on to mat leave.

If you are classed as self employed, you will not be enititled to paid accrued annual leave

The family i work for are my employer Hun, they pay me through a nanny agency payroll. but because I was off sick on the weeks they average out your pay for SMP and i earned under the amount ( I believe my sick pay was around £86 ish a week-but maybe wrong- cant get to where my payslips are Lo asleep!) i hope that makes sense!

so that means as I am employed I should get my 14 days annual leave to take before March 2013?

if you are employed and you are normally entitled to paid holidays, you should accumalate annual leave whilst on maternity and be paid for this.

Looking at your dates, I think you will only be entitled to this years leave ie, march 2012 to 2013 (unless there is a clause in your contact about carrying over annual leave)

check in your contract for your exact terms and conditions
