Hi im not due to return to work until november from maternity leave i am only getting paid smp even though ive worked for the company for 14 years but have decided i want to stay home with sam and i have been really lucky in that i have been offered a job 2 days a week working from home im not sure where i stand with notice etc would i still get smp from my old work until november and when would i need to hand my notice in etc i know that they are going to try and get me to pay my smp back when they know im not returning cos they are really old fashioned and dont understand that even if i had never been going to return they would have still had to pay it and its not that they are doing my a favour (oops rant over) BASICALLY I JUST WANT TO KNOW WHERE I WOULD STAND WITH THE REST OF MY SMP AND NOTICE TO OLD EMPLOYER

You will get smp until you start work again or until the 9 months sml has finished. If you do not wish to return to work after smp you need to write to them giving them notice. Normallly a month but depends on your contract. They cannot withhold payment and they will know the government re pays them the smp they pay you. Even if u start a new job ur smp will continue until you do so or until ur 9 months run out.

I'm 99.99% sure you don't have to pay back SMP if you don't return to work, because it's statutory. Only references I've read about pay back are on company mat pay
