Paternity leave if OH not been with employer at least 26 weeks?

Hi ladies,

Right, so we've started to try and sort out my OH paternity leave (bit late I know!) but neither if us realised that he has to have been with his current employer for at least 26 weeks to claim it...we have recently moved counties which involved him moving jobs too and has only been with them just over 10 weeks :/

Now I'm in a bit of blind panic that he's not going to get any time off or will have to take it completely unpaid!? Anyone been in this situation and know of anything else we can do?

My DH took a mixture of paternity leave and holiday and took 2 weeks off. He used his holidays as the pay was better. Any chance his boss would let him use holidays?
 
My OH took a week unpaid and a weeks holiday since he hadn't been there long enough. His employers were nice though and the holiday didn't come out of his normal annual leave so he basically got an extra week on top of his annual leave fully paid.

I'd ask him to speak to his employer and see what they can do for him xx
 
My hubby wasn't entitled to anything - and as he is a teacher doesn't get annual leave so wasn't allowed time off without pay either!

Have a chat with his employers / their HR. in most places of work I expect they'd be accommodating and allow annual leave or time off without pay xxx
 
Pretty sure he will be entitled the two weeks paternity leave, it will just be unpaid. I *think* everyone is entitled to the actual paternity/maternity leave regardless of how long you've worked for an employer, it's the pay which is determined by how long you've worked for them. Check the direct gov website to be sure though.

Or he could take 2 weeks holiday instead.
 
Parental leave and Income Support
If you take unpaid parental leave, or paternity leave (paid or unpaid), you may get Income Support. You must meet all other conditions for getting Income Support, and be entitled to one of the following benefits:
Working Tax Credit
Housing Benefit
Council Tax Benefit
Child Tax Credit (at a higher rate than the family element)
If you're not entitled to one of the benefits listed above and you take unpaid parental leave, you may still be able get Income Support.
