Strange Situation

Hi I'm new to the forum.

Me and my OH are both feeling ready for TTC.

The problem is that I have been working as a temp through an agency for the same company since November last year and at the moment HR are dragging their heels over making me permenant (been waiting since January).

I know for SMP you must have worked for the company for 26 weeks by your qualifying week but I don't know what were to happen if I were to fall pregnant before I am made permenant. Would I still qualify for SMP becuase I have worked there for so long or not.

If anyone has any ideas I would really appreciate some advice.
 
I'm not sure to be honest, why not speak to citizen's advice or something about your rights? :)

To be honest, i'm not sure if it matters too much because if you're not eligible for Statutory Maternity Pay, then you should definitely be entitled to Maternity Allowance as long as you've worked the 26 weeks.

Maternity Allowance pays a standard weekly rate of £123.06 or 90 per cent of your average gross weekly earnings (before tax), whichever is the smaller, for a maximum of 39 weeks.

SMP pays the first six weeks at 90 per cent of your average gross weekly earnings with no upper limit and then 33 weeks at £123.06 per week, or 90 per cent of your average gross weekly earnings, whichever is the smaller.

So, the two actually work out about the same and you shouldn't lose out on too much. If your weekly earnings are significantly higher than 123.06 then you will lose out for 6 weeks, but after that they'd be the same anyway.

That's really helpful thank you so much for that (I should know all that myself really I worked for ACAS for 3 years :blush:

They are pretty good with maternity stuff where I work so I'm not overly worried. I still want to wait until they make me permenant though so I don't risk losing my job.
