going on the sick

am 23weeks pregnant and have been getting really bad back ache and am finding it hard to stand in work, if i went on the sick would my maternity leave automatically start when the docter signs me off? if not then when would it start ? thanx

Hi Hun,
Just trying to remember correctly about this stuff. You should be ok. If you go on the sick within 2 week (i think) of your leaving date from work then they can force on to maternity leave. As your only 23 weeks gone at the moment you should be fine.

I'm sure this is correct but perhaps someone else could confirm the timescales and i cant quite remember.

i went on sick from 28weeks they cant make you start mat pay unless you go sick in last 4 week so you will be fine if you stay on sick now till mat pay should officially start,you could always use any remaining holidays

i understood sick leave could be triggered within last 11 weeks of maternity leave if sickness can be proven to be linked to pregnancy (e.g. if the flu then not pregnancy related, but if bad back it could be) as maternity leave can start 11 weeks before due date at earliest

however i'm not certain on this...check parental rights websites and you'll find out for sure

Well i was due to stop work at 38 wks and had problems with growth of baby at 30wks and consultant advised me to stop work, i ended up off sick for a week then spoke to my employer who told me in order to begin mat leave i had to get letter from consultant to say it had to begin so i think u should be ok as at 30 wks my employer obv couldnt force it on me. Kx
