Help - if I were to get pregnant while on Mat leave...

Hi,

Ive been searching the internet for answers but im receivng conflicting information so please help.

Had my LO on 11th August. My MAT leave officially strated on 8th August and I just get the 90% for 6 weeks then £128 per week until about April I believe. So nothing on top of the amount the gov set. Income before mat leave was around 25k each year.

If I were to fall pregnant now (or in the next few months)...would I still receve SMP for the next pregnancy? Would I have to go back for a set amount of time to recieve it?

I have 10 days holiday for this year plus 3 bank holidays then my holiday starts again from January at 25 days.

You are still classed as employed while on ML up to 39 weeks so would qualify for a second lot of SMP under the employment rule but it would depend upon your income during weeks 17 to 25 of pregnancy as to how much SMP you get.
You get the lower of £128.73 or 90% of your average gross weekly earnings (which would be the SMP amount).
So in summary you would be entitled to SMP but probably not the full amount unless you have already returned to work.

fab thabks. So I guess I could return to work but actually be taking holiday for 11 days of this years plus half of next years holiday entitlement then maybe go back for a few weeks again then go on MAT leave again. Forgot to mention I have been working my KIT days so the extra earnings should mean I get the full £128.

What happens if I go back part time for a short whle after taking all the holiday? IS there a possibility that I wouldnt get the full £128? Also I assume I would have much less holiday being part tme as it would be pro-rata?
