So I've just had a huge argument with my phone company because well they're absolute arseholes I've been holding my temper for way too long and exploded!!

I've been trying to get my phone repaired for a MONTH!! And they just kept passing me round and 1 store told me to go to Carphone Warehouse which I did they can't repair it because 3 the skank twats bought the handset cheap from the Far East and it isn't covered under a European Warranty and told me to call 3..So I do that to be told because I sent it to Carphone Warehouse my warranty is now void. THEY TOLD ME TO DO THAT BECAUSE THEYRE EFFING SYSTEMS WERE DOWN FOR A EFFING MONTH.

I'm absolutely raging. And I want to cancel my contract and they're saying I have to pay hundreds in cancellation fees that they can screw themselves and take me to court for so they're refusing to let me cancel.

So what I want to know is if I just cancel my direct debit will I face bank charges for them trying to take it when I've cancelled it?
 
Cancelling your direct debit is just masking the issue...your bills will still be accruing and you will still be liable for them until the issue is resolved. Depending on which bank you are with, if a DD is attempted and then returned due to insufficient funds then yes, you would face bank charges. But if you cancel the DD then no you will not face charges as 3 can not take the money as there would no longer be a DD in place.

ETA:

Did you initially take out the phone through CPW? If you did then they are supposed t be the ones covering the warranty, right? What phone have you got? When did 3 tell you to go to CPW? If it was over the phone then you can request the call be listened to. Also, did CPW do anything with the phone? Attempt a repair etc?

Honestly I don't know what else to do they won't let me cancel it and I'm not paying for a contract I have no phone to use and if they seriously think I can afford a new phone they're mental, especially when it's their fault in the first place. They've put my Mum through to the biggest manager in 3 seeing as it was an assistant manager that told me to go there in the first place..I can't even speak to them I'm losing it big time..And they just keep putting her on hold because they don't want to accept the blame. I'm actually fuming!x
 
How long is left on your contract honey? If its anywhere near 6 months you could always try to get a company to buy you out of it, personally I'd call three again, ask to speak to a manager and tell them you're putting in a complaint with human resources. Did you get the name of the person that told you to go to Carphone warehouse with it? Because it sounds like they tricked you, which is completely out of order and I'd be getting someone in trouble over it!

I would email with the the complaint and then proceed to contact the Ombudsman Services. You should also complain to CPW as they need set up a system that doesn't leave the customer screwed over.

I'm also a 3 customer and they are useless
 
I still have a year left on my contract so my buy out charges are ridiculous.

A friend suggested emailing them complaining and I still haven't calmed down enough to do it so that I'm writing it properly and formally at the minute I just want to hurl abuse and their handsets at them. They are and because I went on them and had no problems to begin with my whole family changed over to them too from Orange who again are useless. I've got the guys name and spoke to a big boss..I feel bad getting him in trouble even though it's his fault but like all the people I've spoke to about this haven't once mentioned it screwing me over now I'm gonna be hundreds out of pocket for their faults. It's seriously just the icing ontop of my crap day cake today :cry:
 
I hope things pick up for you :( is it a bad repair? Is there nowhere you could get it down cheaply privately? I've just shattered my iPhone screen, it still works but is gonna be £80 private compared to £150 through apple. Definitely complain, they Should take responsibility if they gave you wrong information
 
Nor it just kept turning off and not turning back on for days for no reason it's not the battery or charger it's the device everyone I've spoke to said it's not a fixable problem and it's been a common fault with my handset because I got it when it first came out they fixed it in the later handsets they were supposed to replace it under the warranty because it wasn't a repairable thing..But because they've voided it they now won't do it. I'll just have to see what they have to say on Monday
 
Canceling your dd will kill your credit rating and you still risk having to pay it all back and more when they send it on to debt collectors.
Im trying to get out of my 3 contract because my phone keeps losing network and their repaires say theres nothing wrong with it so im paying for a service I only get an hour or so each day.
Have a look at the money savers website, they hate 3 other there and alot of them kno the contrant t&c very well so may have some advice.
Back last month there was a major change in their service that ment alot if people could get out of their contract for free but I know they have found a wat out of that now.
 
three are bloody useless. I had a phone with them years ago and it broke within 2 months of having it. stupid me didn't take any insurance out and three would do sod all to fix it. I had to pay 45£ a month for 22 months and in couldnt even use it. I couldn't cancel it, i was pretty much stuck. I ended up buying a crappy little phone as the cost to repair the other was stupid.

never used them again after that. hope you get it sorted.

Sorry just seen your ETA. I got the phone through 3 instore not CPW but the assistant manager in the 3 store told me to take it to CPW as their systems were down and I'd gone so many times and explained this is getting ridiculous now and they refused to call Customer Care and sort it that way, so I did as I was told and went next door. They didn't say whether they had tried to repair it or not they just said it isn't from the UK and isn't covered under EU warranty. I eventually got through to someone who was nice enough to let me cancel but they want £600 to cancel it and she's looked and insisted my phone was manufactured in the UK so I've no idea what on earth they're doing. It's a Blackberry 9900. CPW just told me they don't attempt to repair Blackberrys they just send a new one and 2 different guys in the store told me that so I just don't understand what's happened. They've offered me a £50 refurbed phone for the inconvenience and they can't understand what's gone wrong which is better than paying £500 for a new one or £600 to leave the contract but I'm still £50 out of pocket for their mistakes so I'm going to the store on Monday when the guy who told me to go to the CPW is back and hopefully they'll sort it out where I'm not out of pocket.xxx

I'm glad it's not just me! I won't be renewing with them but then none of the other providers seem to be any better I've been with all of them at some point in the past. They really need to start bringing in some laws to control them at the minute they seem to be able to do whatever the hell they like to customers especially ripping them off :/
 
I'm a bit confused, unless things have really changed since I left phones4u, carphone are an authorised repair centre for everyone so taking it there wouldn't have voided the warranty, we always advised people to take it there first because it's quicker, I even did it myself with a 3 phone. I think you've been lied to none stop to be honest to save them replacing the phone. I've been with 3 for years and they are a brilliant network until something goes wrong and then they are the worst! Good luck x

Is it a carphone with the repair centre in? Your warranty would only be void say if you'd given it in at the market to be repaired or you'd tried yourself. It is a couple of years since I left but I can't see it changing x
 
I'm not sure it's Audley Centre I took it to? I think they sent it to a main Carphone Warehouse repair centre but I'm not sure :/ x
 
Have a loot at your contract, see if there is anything on there they have done that voids their side of it. also I would say go to CAB and see what they say
 
I only got given the short version of my contract with the 'key terms' so will have to see if I can find it online somewhere. A friend of mine recently got his Law degree and told me to send him everything and he'll look at it and see what he can do for me, so hopefully if he's free on Monday I'll take him down to the shop with me and he can blind them with legal terms and threats of legal action until they sort it. Hopefully they'll just admit they're in the wrong and it won't come to that though.x
