Long story short, we were looking for an ipod touch 2nd generation....huby found one in cash generator labeled as a 2nd gen, went in and bought it.
Brought it home and it is infact a 1st generation one, the difference being 2nd has speakers but the 1st doesnt. A factor in why we wanted a 2nd.

Im going back to the shop tomorrow, what are my rights to have the money refunded? I dont want a credit note, they mis labeled it and a 2nd from them if they have one will likely cost more. I now have elsewhere I can get a definate 2nd for the same price, and why would I want a credit note with a shop that cant label their products correctly?!

if it has been mis-represented then they have to offer you a full refund as technically it was their false advertising that caused you to purchase the product. False advertising is illegal and they can be reported for it so I doubt they will kick up too much of a fuss.,
