whether legally separated or just living apart, did you file for custody for your kids?
My mom thinks that should be the first thing i do, but since we are just living apart then would i need to? Its my understanding since we are still going to be married, that technically wed both have custody and if he really wanted to keep the kids he could...but is that true?

Im asking because I want to sort of get the info ill need and contact the court and stuff to get the cost and paperwork needed.

i have not filed for custody of the kids and ive been separated for 2 years now.

i do have primary physical custody as the kids have always lived with me and never with fob and he has never made any attempt to see the kids whatsoever so a judge would award me sole custody anyway.

over here we have whats called a residency order where a judge decides where the kids are to live in the main - is there anything like that over there?

do you think he would want to take the kids to live with him?

We were not together even when I was pregnant, but I still filed for custody as soon as my son was born. I didn't want to leave him the chance to do anything crazy, even though I'm BF'ing, you never know with some judges. I had to file a motion for temporary custody, and if mediation doesn't work will be filing for sole custody. In your case, I'd say at best he could fight for joint. I would be the first one to file though.
