Work not paying me....

I was due back to work on 6th feb after 39 weeks sat may leave, I decided not to return as they wouldn't offer me any less than part time hours, it was full time or nothing...so I handed my resignation in.
Within 2 weeks everyone was on redundancy notices due to lack of work!! How they justified me going back n only full time il never know. Anyway....I was due to be paid for 28th jan - 6th feb on 28th feb, I recieved nothing. When I contacted my employer they told me I wasn't owed anything. When I've looked back my mat leave started 9th may, 39 weeks later is 6th feb, also they didint pay me for any bank holidays last year.
A week & 15 emails later they still haven't gave me an answer or any pay....what do I do now??
 
get all your payslpis together and add up how much actual smp you were paid in total

if it doesnt equate to how much you should have been paid over the period of leave then i would call them once more and ask what they are going to do about it, and explain you intend to take it further

you would be looking to have been paid about 4,080 PLUS 6 weeks at your 90% of pay rate
 
Does that include all bank holidays?
 
You don't get bank holidays given paid in lieu separately - unless they are in addition to your annual leave entitlement not included. Normally you get the option of taking the holiday at the end of your mat leave or getting paid for the days you did not take. Whilst on leave you are entitled to all the holiday days you would have accrued had you been in work - eg if your holiday allowance is 25 days and you hadn't taken any in the 2011 holiday period say you would get all 25 days from 2011 paid in lieu.
 
As a separate point - an employer is only able to use very specific reasons for turning down a flexi-time request. If they said that it had to be full time for business reasons and your post has now been marked for redundancy I would say you potentially have a constructive dismissal case or at the very least some justification for appealing their decision. Would talk to citizens advice about it.

The direct.gov.uk website has links to employment law information including the reasons employers are allowed to give for turning down flexi-time requests.
 
When I discussed my mat leave with my employer they specified I was to be paid for bank holidays. I left the company b4 redundancy notices were given out, only a week b4 cos they wouldn't offer me anything but my normal full time job on the grounds that they wud have to alter the way the business runs to fit me in.
