Hello

Well il explain the situation then see if anyone has any advice.
Im 19 and so is my partner , we signed a short lease hold of 6 months on a property which the rent was 525 pound a month .
At the time we had to prove that we earnt 17,000 a year between us which we did as we were both working full time.
He earns 250 pound a week and i was earning 200 approx a week.
I left my job not long after i fell pregnant due to the fact i was severly sick and my job was classed as dangerous .
James earns 12,000 a year , not enough to keep us and the house . We rang the landlord late january and explained the situation , he said he would sort something . I investigated housing benefit and jobseekers , we arent eligible for either. Im completing a application for contribution based jobseekers , but i may not be able to claim that either. I was also signed off for awhile , i didnt get anything because apparently James earns too much.
During this time the landlord havent done anything to help us , he also did not fix the grill when we were paying rent.- we were also recieving bills for the property which were dated before we moved in but in OUR names ???

We have now been given a eviction notice - im guessing hes going to keep our deposit , but i wont moan about that.
We have paid 2 months rent , the deposit would cover 2-3 months , so we would be left owing him one month , is this worth him taking us to court or anything stupid ?

We didnt know i was going to fall pregnant , we were trying before we moved but not after.

Weve got a appointment with two different councils who should house us acorrding to our local kidstart advisor.

Other than the rent we are up to date with council tax, gas and electric bills. Havent recieved a water bill.

Any advice about this ladies ? Should i just get out of there ASAP , the council will house us according to rooftop who i have just spoke too .
 
I dont understand why you arent entitled to financial help! if you have been signed off work and your OH's salary is £12k then you should get help from the council...

I guess though the biggest problem at the moment is your current landlord. A bit more info, when did you move in, how long have you been there, and what month are you/were you paid up til? how long is left on the agreement?
The deposit you paid is for more than just unpaid rent im afraid. If you are wanting to stay then you need to pay him for the months you have been there (if you havent already)...

A deposit covers all manner of things, including any damage to the property and things inside (you haveto leave the property in the state you received it)
If i'm getting what your saying you've been there for 2 months and have 4 left on the lease but you thought the deposit would cover anohter 2-3months and so you only owe one months rent?
Unfortunately thats not how it works, you owe him the rent for the months you've lived there for and he is entitled to the rest of the rent. If im honest it propbably wont go to court but the landlord may well sell your debt to a collector (they pay him 60% and then get the full amount from you and they can be nasty pieces of work)
If I were you, i'd arrange a meeting with him and disscuss what you'll be able to afford to pay back each month until your arrears are cleared. That way he'll know that your not trying to leave without paying, but if he's nice and can see your in difficulty he may be leniant(sp?) or maybe he'll allow you to find someone to take on the rest of your contract??

firstly the landlord isn't responsible for helping you pay your way so I hope he hasn't intimated he would?

You aren't responsible for the bills before you moved in - the landlord 'should' sort this out but if he's being slow, phone the companies to explain giving the dates you moved in etc and your landlords details and the companies will contact him leaving you alone.

Have you not been paying your rent and that's why the eviction notice has arrived? Have you missed more than one month? The landlord needs to be VERY careful about what he is doing here as there is a strict process he needs to follow. It can be VERY difficult in law to get tenants out of property. If you are able to get housing benefit and get the rent arrears paid before the eviction notice date, the landlord CAN NOT ask you to leave and you will be able to see the rest of the tenacy out - if you wish.

It is illegal for him to evict you in any way that isn't by court action.

You should be eigable for HB as the way the woman I spoke to worked it out was that there has to be £150 PER PERSON per week to live off of. SO £300 a week between you.

Something like that. I would call them back and get them to calculate it again, as I think they are talkingbull shit if you arent entitled.
